Private Charter Terms & Conditions

The terms that apply to every private seaplane charter, transfer and scenic flight operated by Horizon Sun Charters.

Pricing notes

  • The quoted total is based on the confirmed itinerary and may change if the Charterer requests an itinerary, schedule, passenger, payload, or service change.
  • All operations remain subject to aircraft and crew availability, permits and approvals, weather, water and operating conditions, daylight limitations, aircraft performance and weight limitations, and the Pilot-in-Command's safety assessment.
  • Unless otherwise stated in the quotation, the charter price includes the aircraft, crew, fuel, insurance, maintenance, and normal navigation/operating charges applicable to the confirmed itinerary.

Booking & Price

Quotation Validity

Unless otherwise stated in writing, a quotation is valid for fifteen (15) days from the date of issue and remains subject to availability until the booking is confirmed.

Confirmation

A booking is confirmed only when Horizon Sun Charters Corporation (the “Company” or “HSC”) has accepted the booking in writing and the required deposit or payment has been received.

Price Changes

The confirmed price may be adjusted only for Charterer-requested changes, extraordinary third-party charges not included in the quotation, or other items expressly identified in the quotation or agreed to by the Charterer in writing.

Included Costs

Unless otherwise stated, the price includes aircraft operating costs, crew, fuel, insurance, maintenance, normal air navigation/enroute/approach charges, and any services expressly listed in the accepted quotation.

Excluded / Additional Costs

Additional costs caused by a Charterer-requested change, additional waiting or positioning requested by the Charterer, extraordinary airport/handling/permit charges, credit-card surcharges where disclosed, or other agreed additional services may be charged separately.

Delays and Changes Requested or Caused by the Charterer

If a delay, diversion, itinerary change, or additional service is caused by the Charterer's or passenger's request, late arrival, failure to comply with applicable requirements, or other matter within the Charterer's control, reasonable additional costs directly resulting from that change may be charged to the Charterer.

Flight Operations & Safety

Aircraft Unserviceability / Substitute Aircraft

If the assigned aircraft becomes unavailable or unserviceable, HSC may offer a suitable substitute aircraft or an alternative schedule. The Charterer will not be charged an additional amount for a substitute aircraft unless the Charterer expressly agrees to the additional cost before the substitute is arranged. If HSC cannot reasonably provide the contracted transportation, the Charterer may elect to reschedule or receive a refund of the unused charter amount. The Charterer will not be charged the cost of repairing HSC's aircraft.

Pilot-in-Command Authority

The Pilot-in-Command (PIC) has final authority concerning the safe operation of the aircraft and may refuse carriage of any passenger, baggage, cargo, or item, or may delay, divert, discontinue, or modify a flight when reasonably necessary for safety or regulatory compliance. The Charterer and passengers shall comply with the PIC's lawful safety instructions.

Operational Conditions and Approvals

Every flight is subject to required permits and approvals and to safe and legal operating conditions, including weather, water conditions, visibility, daylight, aircraft performance, landing/take-off area suitability, weight and balance, payload limitations, and crew flight-and-duty limitations.

Short-Notice Operations

Flights requested less than seventy-two (72) hours before departure may be subject to additional operational or permit charges, but only where disclosed and accepted before confirmation.

Weather, Safety, Force Majeure and Operational Cancellation

HSC may postpone, reroute, divert, return, or cancel a flight when reasonably required by weather, unsafe water or landing conditions, technical or mechanical conditions, regulatory restrictions, lack of required approvals, crew duty limitations, war, civil unrest, strikes, quarantine, natural events, or other circumstances beyond HSC's reasonable control, or whenever the PIC reasonably determines that continuation would compromise safety.

Refund / Rescheduling When HSC Cannot Operate

If HSC cancels a flight and the contracted transportation is not provided, the Charterer may choose, where reasonably practicable, to reschedule the unused flight or receive a refund of the unused charter amount. HSC is not responsible for consequential or indirect losses arising from such cancellation or delay, including missed airline connections, hotel costs, tours, events, or other onward arrangements, except to the extent liability cannot lawfully be excluded.

Passengers, Baggage & Conduct

Dangerous Goods and Prohibited Items

Dangerous goods, contraband, illicit items, weapons, hazardous materials, or other prohibited items may not be carried unless specifically permitted by applicable law and expressly accepted by HSC. The Charterer is responsible for accurately declaring baggage and cargo.

Smoking

Smoking and vaping are not permitted on board the aircraft.

Passenger Information / Manifest

The Charterer must provide accurate passenger names and any information reasonably required for the passenger manifest, security, permits, weight and balance, or regulatory compliance before departure.

Travel Documents and Legal Compliance

The Charterer and each passenger are responsible for holding any required identification, visas, permits, health/travel documentation, and for complying with applicable immigration, customs, security, localgovernment, and other legal requirements. The Charterer is responsible for fines or penalties imposed on HSC to the extent directly caused by a passenger's non-compliance.

Crew Duty and Operating Limitations

Flights and crew are subject to applicable Philippine Civil Aviation Regulations and HSC's approved operational limitations, including flight-time and duty-time requirements.

Passenger-Caused Damage

The Charterer is responsible for reasonable repair or cleaning costs for damage to the aircraft or its fittings directly caused by the Charterer, a passenger in the Charterer's party, or baggage/cargo under their control, excluding ordinary wear and tear.

Baggage, Payload and Weight Limitations

Baggage and passenger capacity are subject to the specific aircraft, route, fuel requirement, weather and operating conditions. Any quoted baggage allowance or total payload limit forms part of the booking. HSC/PIC may reduce baggage or passenger load where necessary for legal weight-and-balance or safe operation. Alternative baggage transport may be arranged where available and agreed.

Personal Property

Passengers remain responsible for personal belongings and valuables. HSC will exercise reasonable care but is not responsible for loss or damage except to the extent caused by HSC's negligence or where liability cannot lawfully be excluded.

Cancellation & Payment

Cancellation by Charterer

If the Charterer cancels a confirmed flight, the following cancellation charges apply unless a different written cancellation policy forms part of the accepted quotation: (a) From confirmation until more than 72 hours before departure: 20% of the charter price;(b) 72 to 48 hours before departure: 50%;(c) 48 to 24 hours before departure: 70%;(d) within 24 hours of departure or no-show: 100%. Any non-recoverable third-party costs specifically incurred for the charter may also be deducted where disclosed and documented.

Payment

Unless otherwise agreed in writing, the required deposit/payment schedule will be stated in the accepted quotation or invoice. Full payment must be received before departure. A reservation may be released if required payment is not received by the stated deadline.

Charterer / Agent Bookings

Where the Charterer is an agent, DMC, resort, travel company, or other intermediary booking on behalf of passengers or a principal, the Charterer confirms that it has authority to make the booking and communicate these terms to the principal/passengers. Nothing in this clause is intended to exclude rights or liabilities that cannot lawfully be excluded under applicable Philippine law.

Limitation of Consequential Loss

To the extent permitted by law, HSC is not liable for indirect or consequential financial losses arising from delay, diversion, postponement, or cancellation, including missed connections, accommodation, tours, business losses, or other onward arrangements. This limitation does not exclude liability that cannot lawfully be limited or excluded.

Health and Medical Conditions

Passengers should advise HSC before departure of any condition requiring special assistance or reasonably affecting safe carriage. The PIC may divert or discontinue a flight in a medical emergency. Reasonable additional third-party or operating costs resulting from a passenger medical emergency may be charged to the Charterer where appropriate and lawful. Nothing in this clause excludes HSC's responsibility to exercise the standard of care required by applicable law.

Seaplane / Water Operations

The Charterer acknowledges that seaplane operations depend on suitable water, wind, wave, tide, visibility, marine traffic, docking/mooring, shoreline and landing-area conditions. The PIC may change the take-off/landing point, delay, divert, return, or cancel where the intended water site is unsafe or unsuitable. Where reasonably possible, HSC will coordinate an alternative safe location or schedule.

Flight Undertaken at Charterer’s Request When Landing Cannot Be Assured

Where conditions at the intended destination are uncertain and the Pilot-in-Command advises that a landing cannot be assured, the Charterer may request HSC to proceed to the destination to assess the conditions, but only if the Pilot-in-Command determines that it is safe and lawful to commence and continue the flight. No landing is guaranteed. If, after departure, the Pilot-in-Command determines that landing is not safe, lawful, or operationally appropriate and the aircraft must divert, return to base, or return to the point of departure, the flight shall be considered operated and consumed. The applicable charter charge will remain payable and will not be waived or refunded solely because the intended landing could not be completed. The final decision whether to commence, continue, land, divert, or return rests solely with the Pilot-in-Command, and nothing in this clause requires the Pilot-in-Command to attempt or continue an operation considered unsafe or inappropriate.

Departure Time and Passenger Readiness

Passengers must be ready at the agreed reporting/departure time. Seaplane schedules may be constrained by daylight, weather, tides, permits, crew duty, and other operating conditions. Significant passenger-caused delays may require rescheduling or cancellation and may be treated as a Charterer-caused change under these terms.

Safety Information

Passengers must follow crew safety briefings and instructions at all times, including instructions concerning boarding/disembarking, docks, boats, floats, propeller areas, emergency equipment, seat belts, baggage, and movement around the aircraft.

Legal

Governing Law

This Agreement is governed by the laws of the Republic of the Philippines. Any provision that is invalid or unenforceable shall be interpreted or limited to the minimum extent necessary without invalidating the remainder of the Agreement.

Entire Agreement / Priority of Booking Documents

This Agreement, together with the accepted quotation, invoice, itinerary, and any written booking-specific terms, forms the agreement for the charter. If a booking-specific written term expressly conflicts with these general terms, the booking-specific term will prevail for that booking.

Acceptance

By accepting a quotation or offer from Horizon Sun Charters — online, by email or in writing — the Charterer confirms that the itinerary, price, passenger information and booking details are correct and accepts these Terms & Conditions.
